1. Terms of Service
These Terms govern your use of Artdepartment™, including:

Creative services
-
Subscription plans
-
Dashboard access
-
Delivery of digital assets
By creating an account, purchasing a subscription, or accessing Client Dash, you agree to these Terms.
1.1 Eligibility
You must:

Be 18 years or older
-
Provide accurate information
-
Use Artdepartment™ for lawful business purposes
1.2 Account Responsibilities
You are responsible for:

Keeping your login secure
-
All actions taken through your account
-
Not sharing dashboard access with unauthorized parties
1.3 Service Modifications
We may update, improve, or modify the platform at any time.
1.4 Termination
We may suspend or terminate accounts for:

Nonpayment
-
Abuse or violations
-
Unauthorized access attempts
-
Misuse of creative assets
2. Subscription Terms
Artdepartment™ subscriptions are auto-renewing and processed through Shopify.
2.1 Billing Cycle

Renew automatically each billing period
-
Charges occur until you cancel
2.2 Cancellation
You may cancel anytime through your account. Cancellation stops future renewals — it does not refund charges already processed.
2.3 Refunds
Due to the nature of creative work, subscriptions, services, and delivered assets are non-refundable.
2.4 Failed Payments
If a renewal fails:

We may retry the payment

Dashboard access may be paused
-
Work may be placed on hold
2.5 Price Changes
We may adjust pricing at renewal with advance notice.
3. Intellectual Property & Licensing
Artdepartment™ retains ownership of all creative work unless otherwise agreed.
3.1 Default License (Active Subscription Use)
While you are an active subscriber in good standing, you are granted a non-exclusive, worldwide, commercial-use license to use approved final deliverables for your business purposes.
This license:
- Is valid only during an active subscription or project term
- Covers use across marketing, digital, packaging, and commercial applications
- Does not transfer ownership of underlying intellectual property
3.2 Post-Subscription Use
If your subscription ends or is canceled:
- You may continue using previously delivered final approved assets in their existing form
- You may not create new derivative works, modifications, or expansions from Artdepartment™-owned source files unless additional rights are granted
3.3 Source Files & Extended Rights
Editable design files and expanded usage rights are included only with:
- Extended License
- Unlimited License
- Full IP Transfer agreement
3.4 Full IP Buyout (Work-for-Hire Option)
Clients may request a full intellectual property buyout for specific deliverables.
Ownership transfers only when:
- A written Work-for-Hire or IP Transfer agreement is executed
- All associated fees are paid in full
Upon transfer:
- Client receives full ownership rights to the specified deliverables
- Artdepartment™ retains the right to display the work for portfolio and promotional purposes unless otherwise agreed
3.5 Prohibited Uses
Clients may not:
- Resell Artdepartment™ assets
- Repackage or redistribute raw files
- Use drafts, concepts, or explorations without approval
3.6 Ownership Clarification
All underlying systems, workflows, prompt structures, and creative processes used to generate deliverables remain the sole intellectual property of Artdepartment™.
4. AI-Assisted Content & Synthetic Media
Artdepartment™ may utilize artificial intelligence-assisted tools, automation systems, and generative technologies in the development of creative work and deliverables.
Certain deliverables may include AI-generated, AI-assisted, synthetic, or digitally modified imagery, video, audio, or other media.
Client acknowledges that laws, regulations, and disclosure requirements relating to artificial intelligence, synthetic media, and digital likenesses may vary by jurisdiction and may change over time.
Client is solely responsible for reviewing, approving, and determining the suitability of final deliverables for publication, distribution, and use within applicable markets.
Artdepartment™ makes no representation that any deliverable automatically satisfies all jurisdiction-specific disclosure, advertising, endorsement, or synthetic media requirements.
5. Dashboard & Platform Use Policy
Client Dash is a private-access portal for active clients.
5.1 Access Requirements

Must be logged in
-
Must have a valid customer tag
-
Must have an active subscription or project status
5.2 Prohibited Actions
Users may not:

Attempt to bypass routing or access another client’s dashboard
-
Reverse engineer scripts or code
-
Copy dashboard structure or systems
-
Interfere with platform functionality
5.3 Availability
We aim for high uptime but do not guarantee uninterrupted access.
6. Acceptable Use Policy
Users agree not to:

Upload harmful or illegal content
-
Harass team members
-
Abuse revisions or communication channels
-
Use Artdepartment™ services for fraudulent or deceptive purposes
7. Data Processing Addendum (GDPR)
If you operate in the EU/UK, the following applies.
7.1 Data Role

Artdepartment™ = Controller for account data & project files
7.2 Lawful Basis
We process data under:

9. Disclaimers & Limitations of Liability
9.1 No Warranty
Services are provided “as is” without warranties.
9.2 Liability Limits
Artdepartment™ is not liable for:

Printing/vendor errors

Client modifications to provided files

Delays caused by clients or third parties
-
Lost profits or indirect damages
9.3 External Vendors
We are not responsible for performance or mistakes made by manufacturers or contractors.
9.4 AI-Generated Output & Variability
Artdepartment™ may use automated tools, software-assisted systems, and generative technologies as part of its creative workflow, including for ideation, drafting, visualization, mockups, or production acceleration.
Because generative and software-assisted systems are probabilistic in nature:

Outputs may vary between iterations, even when similar inputs are used.

Results depend on the quality, completeness, and clarity of client-provided inputs.

Similar stylistic elements, compositions, or concepts may be generated for other users of similar tools.
-
Early drafts, explorations, and concept variations are not guaranteed to be unique or exclusive.
Artdepartment™ does not guarantee:

That generative-assisted outputs will be entirely free from resemblance to third-party works.
-
That drafts or exploratory concepts will be production-ready without refinement.
-
That any creative output will achieve specific business, marketing, or commercial performance results.
Only final, delivered assets approved and released to the client under the applicable license are considered completed deliverables.
Clients are solely responsible for:

Reviewing all final assets prior to publication or manufacturing.

Conducting independent trademark, copyright, clearance, regulatory, and market-use reviews where appropriate.

Ensuring compliance with applicable laws, labeling requirements, and industry regulations.
By using Artdepartment™, you acknowledge and accept the inherent variability of creative and generative-assisted processes and agree that such variability does not constitute a defect, misrepresentation, or breach of service.
9.5 Creative Variance Tolerance
Creative services, including AI-assisted outputs, design exploration, visual mockups, and iterative revisions, are inherently interpretive and subjective.
ARTDEPARTMENT™ operates under a reasonable Creative Variance Tolerance standard. Minor variations in style, layout, proportion, tone, color interpretation, composition, typographic nuance, rendering detail, or conceptual execution do not constitute errors or defects.
Unless explicitly defined in a written Scope of Work with measurable specifications, an average variance of 25–50% in aesthetic interpretation, stylistic direction, or generative-assisted output relative to early concepts, previews, or mockups shall be considered commercially reasonable within creative industry standards.
Creative Variance Tolerance does not apply to:

Objective factual inaccuracies introduced by Artdepartment™

Failure to implement clearly documented revision requests
-
Technical file corruption or export errors
This tolerance acknowledges the iterative nature of design, the probabilistic behavior of generative systems, and normal creative evolution between concept and final deliverable.
Acceptance of final files, approval for production, or use in commerce constitutes confirmation that delivered work meets agreed specifications within reasonable creative variance.
